Summary

Imagee is an AI-powered image enhancement platform operated by iiniit. By using our service, you agree to upload only content you have rights to, use our tools responsibly, and comply with our acceptable use policy. You retain full ownership of your original and processed images. We process your data solely to provide the service and never use your private images for AI training without your explicit consent. 1. Agreement to Terms
  • •These Terms of Service ('Terms') constitute a legally binding agreement between you and iiniit regarding your use of Imagee, our AI-powered image enhancement platform.
  • •By creating an account, accessing, or using Imagee, you acknowledge that you have read, understood, and agree to be bound by these Terms.
  • •Imagee is a Software-as-a-Service (SaaS) product developed, owned, and operated by iiniit. These Terms are specific to Imagee and supplement iiniit's general Terms and Conditions available at iiniit.com/terms.
  • •If you do not agree with any provision of these Terms, you must immediately discontinue use of the service.
  • •You must be at least 18 years old or the age of majority in your jurisdiction to use Imagee. By using our service, you represent and warrant that you meet this requirement.
2. Service Description
  • •Imagee provides AI-powered image processing tools including: AI Upscaler (up to 4x resolution enhancement), Background Remover, Photo Restorer, Image Sharpener, Noise Reducer (Denoiser), and Cartoonizer.
  • •Our service utilizes advanced machine learning and artificial intelligence models to process and enhance images submitted by users.
  • •The quality and results of AI processing may vary depending on the input image quality, resolution, and content type.
  • •We continuously improve our AI models and service features. We reserve the right to modify, update, suspend, or discontinue any feature or aspect of the service at any time.
  • •Certain features may be subject to usage limits, processing queues, or availability constraints based on system capacity and your subscription plan.
3. User Accounts and Security
  • •To access Imagee's full features, you must create an account with accurate, complete, and current information.
  • •You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • •You must immediately notify us at [email protected] if you suspect any unauthorized access to or use of your account.
  • •One account per user. You may not share, sell, transfer, or allow others to use your account or credentials.
  • •We reserve the right to suspend or terminate accounts that provide false information, engage in fraudulent activity, or violate these Terms.
  • •You are responsible for all content uploaded, processed, and generated under your account.
4. Credits, Subscriptions, and Payment
  • •Imagee operates on a credit-based system. Each AI tool consumes a specific number of credits per operation, as displayed in our pricing page and within the application.
  • •New users can start with our free plan, which includes limited credits and features to explore the service.
  • •Paid subscription plans provide monthly credit allocations. Unused credits from your subscription may or may not roll over depending on your plan type.
  • •Additional credit packs can be purchased separately and remain valid according to our credit expiration policy.
  • •Subscriptions automatically renew at the end of each billing cycle unless canceled before the renewal date.
  • •All payments are processed securely through our third-party payment providers. You agree to provide accurate and complete billing information.

5. Intellectual Property Rights
  • •You retain full ownership of all original images you upload to Imagee. We claim no ownership rights over your original content.
  • •By uploading images, you grant iiniit a limited, non-exclusive, royalty-free license to process, store, and transmit your images solely to provide the requested services.
  • •The enhanced, restored, or transformed images generated by our AI tools belong to you. You are free to use, share, sell, or distribute your processed images.
  • •You represent and warrant that you have all necessary rights, licenses, and permissions to upload and process the images you submit.
  • •The Imagee platform, including its AI models, algorithms, software, user interface, design, branding, and all related intellectual property, are the exclusive property of iiniit.
  • •You may not copy, modify, reverse engineer, or create derivative works from our platform or attempt to extract our AI models or algorithms.
6. Acceptable Use Policy
  • •You agree to use Imagee only for lawful purposes and in compliance with these Terms and all applicable laws.
  • •Prohibited content: You may not upload or process images that contain illegal content, child exploitation material, non-consensual intimate imagery, extreme violence or gore, content promoting terrorism or hate speech.
  • •You may not use Imagee to create deepfakes, manipulated media intended to deceive or harm individuals, or content that infringes on others' intellectual property rights.
  • •You may not use automated scripts, bots, or other means to access the service in ways that exceed normal usage patterns or circumvent usage limits.
  • •You may not attempt to probe, scan, or test the vulnerability of our systems or breach any security measures.
  • •Violation of this policy may result in immediate account termination, forfeiture of credits, and reporting to appropriate authorities.
7. Privacy and Data Protection
  • •Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy at /privacy.
  • •We do not use your private images to train our AI models without your explicit opt-in consent.
  • •Uploaded images are processed on secure servers and stored temporarily to enable download and history features. You can delete your images at any time.
  • •We implement industry-standard security measures including encryption in transit (TLS/SSL) and at rest to protect your data.

8. Service Availability and Support
  • •We strive to maintain high service availability but cannot guarantee uninterrupted or error-free operation.

9. Disclaimer of Warranties
  • •Imagee is provided on an 'AS IS' and 'AS AVAILABLE' basis without warranties of any kind, whether express, implied, or statutory.
  • •We do not warrant that the service will meet your specific requirements, that results will be accurate or satisfactory, or that any errors will be corrected.
  • •AI-generated results are provided for general use. We make no guarantees regarding the suitability of processed images for any particular purpose.
  • •To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
  • •To the maximum extent permitted by applicable law, iiniit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • •This includes, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses arising from your use or inability to use the service.
  • •Our total cumulative liability to you for any and all claims arising from or related to these Terms or the service shall not exceed the total fees you have paid to us in the twelve (12) months preceding the claim.
  • •Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
11. Indemnification
  • •You agree to indemnify, defend, and hold harmless iiniit, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees).
  • •This indemnification applies to any claims arising from: your use of the service, your violation of these Terms, your violation of any third-party rights, or content you upload or create using the service.
12. Account Termination
  • •You may cancel your subscription or delete your account at any time through your account settings or by contacting [email protected].
  • •Cancellation takes effect at the end of your current billing period. You will retain access to paid features until then. See our Payment Policy for refund details.
  • •We may suspend or terminate your account immediately and without prior notice if you violate these Terms, engage in fraudulent activity, or pose a risk to our service or other users.
  • •Upon termination, your right to use the service ceases immediately. We may delete your account data, including uploaded and processed images, in accordance with our data retention policy.
  • •Termination does not relieve you of any obligations incurred prior to termination, including payment obligations.
13. Modifications to Terms
  • •We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website.
  • •For material changes, we will provide notice via email to your registered email address or through a prominent notification on the platform.
  • •Your continued use of Imagee after the effective date of any changes constitutes your acceptance of the revised Terms.
  • •If you do not agree to the modified Terms, you must stop using the service and may cancel your account.
14. Governing Law and Disputes
  • •These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.
  • •Any dispute arising from or relating to these Terms or your use of Imagee shall be subject to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh.

15. General Provisions
  • •These Terms, together with our Privacy Policy and Payment Policy, constitute the entire agreement between you and iiniit regarding Imagee.
  • •Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
  • •If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • •You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • •These Terms do not create any agency, partnership, joint venture, or employment relationship between you and iiniit.
